These Terms of Service ("Terms") govern your access to and use of Nova Essentials and the permit lead platform at leads.novaessentials.ca (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Nova Essentials aggregates building permit data from official city open data portals — including the City of Toronto Open Data portal and the NYC Department of Buildings (NYC DOB) — and presents it in a searchable dashboard for contractors and construction professionals.

All permit records displayed are public documents sourced from government open data. We do not create, alter, or fabricate permit records.

Nova Essentials provides permit lead data to help you identify work opportunities. We do not send outreach on your behalf. You are solely responsible for how you contact property owners identified through the Service.

Building permit records are public documents. Referencing them does not, by itself, create a legal right to contact a property owner in any particular way. Consult a lawyer if you are unsure whether your outreach practices comply with applicable law.

6. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. Lead scores and estimated project values are algorithmic estimates for informational purposes only — they are not appraisals, guarantees, or professional advice.

7. Limitation of Liability

To the fullest extent permitted by law, Nova Essentials shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 3 months preceding any claim.

8. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Disputes shall be resolved in the courts of Ontario.

9. Changes

We may update these Terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
